Appendix: Terms and Conditions – Information for Package Travel Arrangements

The following information applies only to package holidays within the meaning of EU directives and does not apply to accommodation bookings.

The combination of travel services offered to you constitutes a package holiday within the meaning of Directive (EU) 2015/2302. You therefore benefit from all EU rights that apply to package holidays. Mühlentor Gastro GmbH bears full responsibility for the proper performance of the entire package holiday.

Key rights under Directive (EU) 2015/2302: Travellers will receive all essential information about the package holiday before the package travel contract is concluded.

Mühlentor Gastro GmbH is always liable for the proper provision of all travel services included in the contract.

Travellers will receive an emergency telephone number or details of a contact point through which they can contact the hotel as the tour operator.

Travellers may transfer the package holiday to another person within a reasonable period and possibly subject to additional costs. The price of the package holiday may be increased only if certain costs (for example, fuel prices) rise and if this is expressly provided for in the contract, and in any case only if the increase is communicated in text form no later than 20 days before the start of the package holiday.

If the price increase exceeds 8% of the package travel price, the traveller may withdraw from the contract free of charge. If a tour operator reserves the right to increase the price, the traveller is entitled to a price reduction if the relevant costs decrease.

Travellers may withdraw from the contract without paying a cancellation fee and receive a full refund of all payments if one of the essential elements of the package holiday, other than the price, is significantly changed.

If the trader responsible for the package holiday cancels the package holiday before it begins, travellers are entitled to a refund and, where applicable, compensation.

Travellers may withdraw from the contract before the start of the package holiday without paying a cancellation fee if unavoidable and extraordinary circumstances occur, for example if there are serious security problems at the destination that are likely to significantly affect the package holiday.

In addition, travellers may withdraw from the contract at any time before the start of the package holiday by paying an appropriate and justifiable cancellation fee.

If, after the start of the package holiday, essential elements of the package holiday cannot be provided as agreed, appropriate alternative arrangements must be offered to the traveller at no additional cost. The traveller may withdraw from the contract without paying a cancellation fee (in the Federal Republic of Germany this right is referred to as “termination”) if services are not provided in accordance with the contract, this has a significant impact on the performance of the contracted package travel services, and the tour operator fails to remedy the situation.

The traveller is entitled to a price reduction and/or compensation if the travel services are not provided or are not provided properly.

The tour operator will provide assistance to the traveller if the traveller is in difficulty.

In the event of the insolvency of the tour operator (hotel) or, in some Member States, the travel agent, payments will be refunded. If the tour operator or, where applicable, the travel agent becomes insolvent after the package holiday has begun and transport is included in the package holiday, the repatriation of travellers will be ensured.

As a general rule, the tour operator (hotel) does not require advance payment for its package holidays before the start of the trip; therefore, no protection in the form of a so-called security certificate (Sicherungsschein) is provided.
